(1) Definitions
In these terms and conditions the following meanings will apply:-
"The Company" means Cannon Electrical Supplies, whose office is at 222 Main Road, Biggin Hill, Westerham, Kent TN16 3BD.
"Customer" means the person, company or organisation whose details are entered on any order or enquiry form of Cannon Electrical Supplies.
"Browser" means any person accessing and using this website by means of software products enabling Internet connection.
"The Website" means the website at www.cannonelectrical.com.
(2) Placing an Order
Placing an order is very simple. Just browse around The Website using the product guide on the left hand side of the window until you find the item you require. If you are buying a light fitting look at the dimensions and check using a tape measure to see how far it will hang down from the ceiling. If you are buying a heater, check the dimensions to make sure it will fit into the space you have available. Returning products (pursuant of Clause 8 below) can be very time consuming and the customer is responsible for the cost of return postage and any handling charges levied by the manufacturer or their Agents. Now type in the quantity and click on any other details such as colour, etc. You can now move onto the next item if you wish or if you have finished shopping, click on Basket. Now that you can see the items in your basket, you can check the quantities and descriptions and then click on Checkout. You will now go to a payment page where you can fill in your name and delivery address etc, make payment with your card and complete the transaction.
(3) Special Orders
Non-stocked products, products specially made or modified and cable cut to specified lengths will be non-returnable by the Customer. Notwithstanding, acceptance of returns by the Company in exceptional circumstances for non-stocked products will be subject to the Terms and Conditions of the Company's supplier. Carriage and postal charges for returns will be paid by the Customer and any refund or part refund will be solely at the discretion of the Company.
(4) Price and Payment
Prices shown on the website are exclusive of VAT, which is applicable on all consumer sales throughout the European Union. The Company reserves the right to vary prices to reflect changes in price from its suppliers without notice and the contract price will be the price quoted in the contract confirmation.
The price of the contract will require to be paid in full (except for account customers) prior to dispatch of the products or fulfilment of the services unless otherwise agreed. Payment is of the essence of the contract and the Company will be relieved of any obligation under the contract if payment is not made in accordance with the contract terms.
(5) Delivery
Stocked products are dispatched next day, non-stocked products and back orders are usually dispatched within 3 to 5 working days. Heavy items such as night storage heaters and fire suites but not exclusively are only delivered to (ground floor entrance only) most areas of the South East of England with a delivery charge of £4.95 + VAT. (6) Shortage, Damaged and Non-Delivered Goods
Delivered goods must be signed for as being unexamined or damaged. Shortages and damaged goods must be reported immediately but within two days in writing to the Company and carrier with any damaged packaging and goods being kept for inspection by the carriers. Non-delivery of orders must be reported to the Company in writing within seven days of the order being placed with the Company. Should the Customer fail to notify the Company or carrier in compliance with thhe terms of this Clause, the Company will accept no liablity whatsoever for shortages, damages or non-delivered goods.
(7) Title and Risk
Title in the goods will pass to the Customer on payment of the full purchase price including any VAT due. Risk however, will be carried by the Company until such time as the products are delivered to the address provided by the Customer.
(8) Returns
Under no circumstances will goods be accepted as returns without an authorisation number.
In the unlikely event of products being faulty or of sub-standard quality, please report such problem immediately to the Company using the enquiry form or contact details on the Website and the cost of return and replacement will be met fully by the Company. Goods must be returned together with the original box, packaging and any booklets, etc.
A change of mind or ordering mistakes with regard to size, colour or specification for example but not exclusively will not constitute grounds for cancellation by the Customer. Notwithstanding, acceptance of cancellation by the Company subject to agreement by the manufacturer or their agents under certain circumstances.Goods agreed for return and under cover of an authorisation number must be returned in their original unopened boxes complete with all packaging and documentation. Boxes must not be defaced and in a resaleable condition. The customer will be responsible for the cost and safe return of the goods and any handling charges arising from their return.
(9) Liability
To the maximum extent permissible in law, the Company excludes all liability for any loss or consequential loss however incurred by the Customer, arising from any action or omission or failure by the Company in connection with the contract.
In any event the maximum liability of the Company will be not more than the purchase price of the products or services under the contract, should the fulfilment of the contract be late or cancelled for any reason.
(10) Warranty
Manufacturers provide a full guarantee on their products usually between 12 months to life and it is the Customer's responsibility to immediately upon receipt of the product register the guarantee with the manufacturer. Manufacturers' guarantees are subject to their terms and conditions of use and no guarantee is offered where products are used for purposes other than that for which they were designed.
Products offered for sale in our clearance section are specifically excluded from any guarantee.
(11) Data Protection
To facilitate effective processing of orders the Company offers secure payment facilities online, via the website and can accept payment by major credit cards or debit cards by this method. To this end cookies are used by the website server to track order details only and Customers are asked to accept these files from the website server.
Alternatively payment may be made in person at the Company's premises or by cash, credit card, debit card or bank transfer by arrangement at time of contract.
(12) Privacy
Personal details are encrypted during transmission and stored and used strictly in accordance with the Company's Data Protection Policy and will not be passed to any third party except for couriers to deliver your order without your explicit permission.
(13) Force Majeure
In the event of circumstances outside the Company's control affecting the performance of the contract, the Company will be entitled to notify the Customer and revise or cancel the contract to reflect the changed circumstances and the Customer will accept such changes.
(14) Copyright
The website is owned and operated by The Company and all contents and designs are copyright of The Company and its suppliers or agents. Browsers using the site are permitted limited rights to view and print the contents for personal use only and are prohibited from copying or reproducing or reusing any of the contents or designs in any medium for any other purpose, in particular but not exclusively for any commercial gain.
(15) Notices
All communications in connection with the contract will be deemed to have been served if sent by ordinary mail to the Customer's postal address or by email to the Customer's email address, as notified to the Company by the Customer. (16) Law
Unless otherwise agreed in writing, the contract when formed will be deemed to have been concluded in England and will be interpreted, construed and enforced in all respects in accordance with the laws of England, and will be subject to the jurisdiction of the English Courts.
